Allen (D) was an agent in the collection of monies for his principal. D was convicted of obtaining title by false pretenses to $400 of which he was in possession as an agent. The jury was instructed that it did not matter whether D was paid the money by his principal or whether he collected it for his principal. D applied for a rehearing.
