Facts

Three couples applied for marriage licenses and were refused because they were of the same sex. A statute in Hawaii law excluded from eligibility for married couples of the same sex. Ps sued pursuant to their right to privacy, equal protection and due process under the Hawaii Constitution. Lewin (D) filed a motion for judgment on the pleading, and it was granted. Ps appealed.
