Facts
Bush (P) entered into a contract with Canfield (D) to supply flour under the specifications in writing. D breached the contract and P sued. D plead not guilty. The trial court read the jury instructions that the damages should be the sum advanced by P and the interest. The jury gave the verdict to P for $6771. D moved for a new trial.
