Facts

The City of Piqua (D) maintained a series of ponds to store a water reserve for its reservoirs. One of these ponds was near Morris (P)'s farm and was negligently maintained. During a large flood, water broke loose from this pond and flooded P's farm. P sued D for damages on the ground of its negligence. D received judgment at trial. The intermediate court of appeals reversed. D appealed.
