Facts

American Aggregates operated a limestone quarry and extracted water from the pits. This affected neighboring landowners. Cline (P) and others sued American (D) to stop its pumping in that is unreasonably caused dewatering and pollution of Ps’ wells. The trial court granted summary judgment to D as the state did not recognize a cause of action for Ps’ injuries. The court of appeals affirmed but suggested that the law on point should be reexamined.
