Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
P sued D alleging a nuisance from the noise created by D’s business. The court below found that the noises made by D were not reasonably endurable or bearable and rendered P’s home unfit for use as a residence of a reasonable and ordinary person. The court then gave judgment to P and rendered a decree that ordered P to abate the nuisance. D appealed; the decree (listed on page 281 Re 5th) did not specifically point out the things that D was supposed to do to abate the nuisance.
