Facts
Rudell (D) signed a contract with Comprehensive (P) to acquire an accounting franchise. The contract contained a standard arbitration clause. P decided to terminate D's franchise and invoked the arbitration clause. D did not participate in arbitration as he could not afford to go to Chicago and couldn't see that there was anything left to arbitrate. Arbitration was conducted and resulted in an award for P. P moved for confirmation by the federal district court for a judicial order to compel D's compliance with the arbitrator's award. The district court enforced the order and D appealed.
