Facts

Ross Danielson (P) was a lecturer at City College, a branch of the City University of New York. His wife, Susan became pregnant, and it was decided between the two that Susan would continue work and P would take off time to take care of their child for the first six months after birth. P made every effort to obtain parental leave of absence, but such leave was available for women faculty members only. P sued under Equal Protection. D moved for summary judgment.
