Facts

Duldulao (P) was hired by D in 1968. She was rehired in 1970 when she returned from a brief stay in the Philippines. By 1971, P was promoted to head nurse and in 1972 was named staff development coordinator of the nursing department. By 1981, P became the human resources development coordinator. By December 1981, D was given a probationary evaluation and a final notice informing her that she was terminated at the end of the day. D alleged that P did not properly perform her job. P claims that the termination violated procedural rights she had by virtue of an implied contract with D. P claims those terms were found in an employee handbook distributed by D. D first published the book before P was rehired in 1970. That book was revised in 1975 and required that certain procedures be followed in terminating permanent employees. P was a permanent employee under the terms of the handbook. Both parties moved for summary judgments. The trial court denied P's motion and granted D's. The appellate court reversed both rulings. D appealed.
