Facts

Dutton (P) was a third-party beneficiary and brought an action to enforce Poole's (D) promise that D would pay his sister (P's wife) 1,000 pounds if his father would not sell certain forest land he had planned to place on the market. The father agreed not to sell, and D never paid his sister.
