Facts
Economopoulos (P) was accused of stealing a handkerchief by the agent of Pollard Co. (D). A clerk told P of the accusation in English, and the statement was repeated to P in Greek by a Greek clerk of D. There was no evidence that anybody but P was present when Carrier spoke to P in English. There was no evidence that anyone understood the Greek statement either. P brought a defamation action against D for statements allegedly made regarding accusations of larceny on P's part. The verdict was given to D and P appealed.
