Facts

Cora Fennell (P) suffered a severe headache and was taken to the emergency room. A CT was performed, and from that, the Hospital (D) should have given P a lumbar puncture, and if done, P would have had a 40% chance of surviving meningitis. D did not, and P died, and the estate sued D for negligence. P lost the verdict and appealed.
