Facts
Apparently Minker (P) began doing work for Gem Broadcasting (D) but there was an unaccepted proposal, and eventually P sued D under an implied in fact contract theory. The trial court found an implied in fact contract for P to provide D with consulting services. The trial judge found that P worked for 30 days and that his services were valued at $385 per day. This appeal resulted. D contends that the trial court was precluded from considering P’s unaccepted proposal for a contract when assessing the reasonable value of the services. D also argues that P may not recover on a quantum meruit claim because he failed to establish that he conferred a benefit.
