Gibson (D) was picked up by police for attempted auto theft. When they booked him, they found $162 on Gibson and in his sock, they found credit cards, bank cards, and various pieces of identification belonging to Larry Williams. When Williams was called by the police, he told them his wallet was stolen from his car and that the car was parked near the Eagle's Lounge and that it contained about $160 in cash. D was picked up by police near the Eagle's Lounge. At trial, D's mother testified that when she had dropped D off at the Eagle's Lounge that night that she found a wallet lying on the ground and that she tossed to wallet in the truck intending to ask D's father to find the owner later. When she came out of the bar with Gibson's father, Gibson was gone and so was the wallet. D was convicted and appealed.
