Facts

Goddard (P) was a passenger who had just arrived, and was about the length of a train car from leaving the train when he slipped on a banana peel lying on the platform, fell, and was injured. There was evidence of many people on the platform at the time of the accident. The verdict was directed for D, and P excepted.
