Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Goldinger (P) sued Boron (D) for wrongful termination of his employment contract in that D forced him to sell gasoline at prices fixed in violation of the antitrust laws. P sought the answers to a series of interrogatories for the production by D of new contracts entered into with other dealers and the changes contained in them as well as the reasons for those changed. D objected to the discovery on grounds that the contracts were not relevant and that they were protected from discovery by the attorney-client privilege.
