Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Gore (P) filed a complaint for injuries she sustained in an auto accident. P was an emancipated minor. Stowe (D) demurred, in that the action was filed more than one year after the accident and as such was barred by the statute of limitations. When P was 17, she filed a verified petition to become emancipated and it was so granted by the court. Two weeks later P was injured in an auto accident and one year and three months after the accident she filed her complaint. P appealed.
