Facts

P occupied a room in D's dwelling house. D noticed P that his tenancy at will would end on April 2nd. P refused to vacate and still remained on April 6th. On that Day, D with the deputy sheriff and two of D's nephews went to the premises but were refused entry by P's wife. D eventually got entry through a back door which was not locked. P eventually returned and made a deal for the back rent and was permitted to remain until another place to live. P sued D.
