Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Liederbach (D) drafted a will for Kent. The will provided that Guy (P) was to be the beneficiary of the residuary estate after payment of a specific bequest of $4,500 to Kent's sister. The will was signed by Kent and witnessed by D, and P. Kent died, and the will was submitted to probate, but the legacy to P was invalidated because she was a subscribing witness to the will. P filed an action against D and D filed a demurrer in that there was no attorney-client relationship between P and D. The lower court dismissed the action. P appealed.
