Facts

Hall (P) was a truck driver employed by D. While driving a truck for D, P attempted to rescue a woman who had been involved in an accident. P was injured in the course of that rescue. P sued D in worker's compensation. The trial court dismissed the action because P's injuries did not arise out of an in the course of P's employment. P appealed.
