Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Richard Harmon (P) claimed that his brother and sister-in-law, Harold C. Harmon (D1) and Virginia S. Harmon (D2) had fraudulently induced P's mother to disinherit P. In 1976, the will left at a one-half interest in the mother’s property to P. P's mother was 87 and in ill health when the action was commenced. Apparently, Ds induced the mother to give the property to them. P's action was dismissed; it failed to state a cause of action, and P lacked standing to bring suit. P appealed.
