Facts

Katherine (P) and David Helsel divorced in January 2001. P filed suit against D for alienation of affection, alleging that D intentionally interfered with the marriage and caused it to fail. A jury returned a verdict in favor of P. D filed post-trial motions in the trial court to abolish the tort of alienation of affection. The trial court declined. D appealed.
