Facts

The White case ordered every welfare department in Illinois to establish standards for welfare eligibility, and notice and hearing procedures for the grant or denial of applications for welfare. The Land of Lincoln Legal Assistance Foundation filed this suit to make all welfare departments comply with the White case. The suit was on behalf of Henson (P) a resident of East Lincoln Township (D) and every other person in 65 Illinois counties who have been denied due process of law and against the local welfare departments, a total of 770 departments in 65 counties. The district judge denied certification of the defendant class under 23(c)(1) on the ground that 23(b)(2) does not permit defendant classes. The district court denied certification.
