Facts
Iowa Automobile Mutual Insurance Co. (D) issued a policy to Hesson (P) insuring a Buick touring auto from theft. P alleged that the car was stolen on 10-9-21 and claimed a loss of $1,350. D defended in that P never had an insurable interest in the car. At the conclusion of testimony, D moved for a directed verdict on grounds that the auto insured was a stolen auto and P did not and could not have an acquired ownership and as such had no insurable interest in the car. The verdict went to P and D appealed.
