Forth Worth conducted a dual box election for a tax bond to authorize the sale of bonds to build a city library. In one box property owners voted. In the other box, all other registered voters cast their ballots. The measure would only pass if both boxes approved by majority the measure being voted upon. In this particular election 24,000 voted in the nonproperty owner box and 5,000 voted in the property owner box. The measure was approved by a majority of all voters but because there was no majority in the property owner box it was deemed not to have passed. Three of the nonproperty owners filed suit under Equal Protection.
