Facts

P owned the Three Captains House of Seafood Restaurant in Bladensburg. P’s restaurant had topless dancing. Bladensburg enacted a city ordinance that prohibited topless dancing in establishments that serve alcoholic beverages or food. Ds are the mayor and the town councilmen of Bladensburg. P filed suit and sought a temporary restraining order under Rule 65 of the Federal Rules. This was the ruling by the court.
