Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
Hurwitz (P) and Padden (D) formed a two-person law firm. They failed to enter into a written agreement. Eventually, articles of organization were filed which established the firm as a limited liability company. In February 1996, D informed P that he wanted to dissolve the relationship as of March 1, 1996. They resolved all business issues except for a division of attorney fees from several contingency cases. P then filed this present action to resolve those matters. The trial court found in favor of P and decided that the fees should be split and as such entered judgment for P of $102,750. D appealed.
