Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Zastrow's will provided that if she were predeceased by her nephew, Robert, his share of her estate would pass to the child of his body or children of his body. Robert was the natural father of Glen and Michael. After divorcing Robert, the natural mother married Roger who adopted the boys. Robert died thereafter. The trial court held that the adoption of the children by Roger removed them from the category of children of the body of Robert. This appeal resulted.
