Jackson (P) sued D for injuries related to asbestos products. P was injured as a result of his exposure to asbestos products when he worked in a shipyard. P got judgment and was awarded $391,000 in compensatory damages and $625,000 in punitive damages. D argued that before jury instructions were given that punitive damages should not be allowed to go to the jury and that even if awarded they should be vacated. D claims that the uniqueness of the factual context in a mass tort case makes punitive damages inappropriate as a matter of law. This appeal resulted.
