This was an action to contest the validity of the will of Mrs. Gaffey. It was claimed that the testatrix was not of sound, disposing mind, and memory and was under undue influence. The issue of an account book of a Dr. McWilliams who treated Mrs. Gaffey was brought to the court's attention. P wanted the entries to show evidence of the facts stated therein, what the Dr. had treated Mrs. Gaffey for when he visited. The Dr. was dead, and the statements were against his interests. The evidence was not allowed at trial and P appealed the verdict.
