Facts

P got a letter from his employer that as he was retiring from his position, they wanted to give him an official letter of commendation for long and faithful service and that the directors have decided that P was to get a $100 per month pension as long as he would live to preserve his attitude and loyalty to the company and to not be employed in any competitive occupation. D paid the sum of $100 for four years and then P was notified that D would no longer continue the payments. The lower court found for D and P appealed.
