Leech (D) purchased a Pontiac automobile and gave his promissory note for $1000 secured by the car. About one year later, with installments delinquent, D took the car from his residence, concealed it out of sight, and then reported the car stolen. The insurance company paid the policy. D was eventually caught and his accomplice, Holman, turned state’s evidence. D claimed that Holman was the actual perpetrator. During direct examination, the prosecutor asked Holman if he had plead guilty to the charges for the same crime that D was charged with and the answer was a 'Yes, Sir.' No objection was made to this line of questioning. D filed a writ.
