Facts
The Respondent, the State of Arkansas, successfully sued the Petitioner three months after the Petitioner began construction on a government air force building in Arkansas. The Respondent asserted that the Petitioner lacked the appropriate licensing credentials to undertake this construction project pursuant to an Arkansas law. However, the Petitioner contended that the Arkansas law impeded the ability of the federal government to recruit individuals in general and procure contractors in particular under the Armed Services Procurement Act of 1947. The Arkansas State Court affirmed the decision in favor of the Respondent. The U.S. Supreme Court reversed and remanded.
