Facts

Lieberman (P) sued the University of Chicago (D) and others claiming that she was denied admission to its medical school as a result of sexual discrimination in violation of Title IX of the Education Amendments of 1972, 20 U.S.C. 1681(a). P sought compensatory and punitive damages. Ds admitted that they received federal financial assistance but denied the allegations of discrimination. D then moved for a summary judgment. The district court ruled that Title IX does not provide a damage remedy and granted D’s motion. P appealed.
