Facts
Long (D) moved from Delaware to Arkansas to obtain an Arkansas divorce and stayed long enough to get one. D then moved back to Delaware. D did this on the advice of his attorney. D then married another woman. D was charged with bigamy. The trial court held that an Arkansas divorce could not be recognized in Delaware. D made a mistake of law. The bigamy statute was required only a general criminal intent. D was convicted. D appealed.
