Facts

Magee (P) and Rose (D) lived under a common law marriage. P had a daughter from a previous relationship, and both had a son together. A single-car crash occurred, and P died almost instantaneously. The daughter was cared for by P's parents, and the son was cared for by D. P sued D for wrongful death and survival action. D moved for a summary judgment.
