Facts

P alleged that she lacked the mental capacity and that under the manner and circumstances, D frauded her into obtaining her signature to a deed. P did not plead this fraud with the required specificity required under Rule 9(b). The trial judge refused to permit P to amend her complaint and submit the issue of fraud to the jury. P appealed.
