Facts

McConico (P) owned unenclosed and unimproved land. P ordered Singleton (D) that he was not welcome to hunt on his land and forbid him from doing so. D ignored P and went deer hunting. P sued D in trespass. The jury ordered each to pay their own costs. P moved for a new trial on grounds of trespass. The Court of Appeals for South Carolina heard the appeal.
