Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Under the will of Michael, who died in 1910, a trust was created with McDonald as the trustee under a trust with terms to pay Michael's widow $25 monthly, and such additional sums as the trustee deems necessary for her needs, condition, and station in life. In November 1920, Mary, the widow, filed a bill of complaint in the court below against the trustee in that he refused to pay her sufficient funds to maintain her station in life even though sufficient funds were available for such a task. She also charged that he was hostile to her and asked that he be removed as trustee. The court granted her prayer and removed the trustee. This appeal resulted.
