Facts
On October 1, 1940, Coca-Cola (D) announced, via a news article and statements made by William Feinberg, manager and secretary of D, that any employee called to military action would not 'lose a cent in wages.' The plan was for D to pay the difference between an employee's salary and their military pay while enlisted. In October of 1942, Mickshaw (P) received notice and enlisted in the Coast Guard, returning to D's employ in December of 1945. In May of 1947, he quit D and finally made a demand for the pay difference in September of 1947, claiming $3,588.
