Facts
P's national heritage is Russian. She moved to the United States in or around 2005 and graduated from high school in 2015. In April 2019, P was hired by D as a seasonal firefighter. P claims she began to experience discriminatory treatment by her supervisor, John Kearney, based on her sex/gender and her national origin and immigration status shortly after her employment began. P complained to HR but did not provide any details. P went to another supervisor, Paul Nelson, to inform him of the 'disparate treatment based on her sex/gender and national origin and immigration status.' Kearney gave P a poor performance evaluation. P alleges this was in retaliation for 'complaining of disparate treatment.' P did not specify the kind of disparate treatment she complained about. P was transferred to a different engine. In December 2019, P reapplied for the 2020 fire season. In January 2020, P was informed she would not be rehired because she was 'not a good fit' for the program. P filed a Complaint in this Court on December 9, 2021, raising the following causes of action: (1) discrimination based on sex/gender and national origin and immigration status in violation of Title VII and (2) retaliation in violation of Title VII, and (3) wrongful termination in violation of public policy under Washington's common law. D moves for summary judgment only as to P's claims premised on national origin and immigration status, as well as all causes of action arising under state law. D also seeks to exclude the testimony from P's expert witness, Robert Dietrich. D seeks to exclude the expert opinion provided by Robert Dietrich on the basis that it provides only conclusions of fact and law.
