Facts

Moffet (D) made a list of things she would need to kill Linda Exner. D listed a suicide note she wanted Exner to write, rope, a quantity of sleeping pills sufficient to kill, and the keys to Exner's apartment. D and a boy entered the apartment when Exner was asleep and tied Exner up. The boy held a knife to her throat and D told Exner to copy the suicide note. Exner escaped before D could force her to take the pills. D was convicted of attempted murder and appealed; her acts never went beyond mere preparation.
