P was injured while working as a longshoreman. P collected worker's compensation benefits from the stevedoring firm for which he worked. P then hired D and brought a third-party liability suit against the shipowners in Maine's federal district court. D was to get 1/3rd the recovery. While the third-party suit was in progress, the shipowners offered to settle first for $70,000 and later for $90,000. D failed to relay either offer to P. P lost the suit and then sued D in malpractice. P claimed he would have accepted the $90,000 offer. Following a jury trial, P was awarded $12,000. D appealed from the denial of his motion for a directed verdict.
