The Petitioners, three military privates, attempted to avert the Army draft during the Vietnam War by seeking a declaratory judgment to show military participation in this war was illegal. The district court dismissed the case. The Court of Appeals affirmed the dismissal. The U.S. Supreme Court denied certiorari.
