Nash (D) demurred to two complaints under the Sherman Act in that the complaints were too vague. Neither of the accounts alleged any overt act and that the contemplated acts and things would not have constituted an offense if they had been done. The demurrer was overruled, and eventually, the Supreme Court granted certiorari.
