Facts

Nichols (P) promised to deliver a cow to Raynbred (D) for 50 shillings. D did not pay the money nor did P deliver the cow. P sued D for assumpsit. P prevailed. The court held that P need not aver that he delivered the cow in order to bring suit. D appealed.
