Facts
Nielson (D) was a citizen of the state of Washington who had a license from that state to operate a fishing net on the Columbia River. D was arrested by Oregon officials while exercising his license within the limits of the state of Washington. D was charged with violating an Oregon statute, which prohibited use of the fishing net. An act of Congress gave both Washington and Oregon concurrent jurisdiction over the Columbia River. D was convicted and appealed.
