Facts
P was charged by a fellow union member with violating the union constitution by distributing information that was allegedly detrimental to the union. P was fined and temporarily suspended, but that determination was suspended with it was found that the local union had no jurisdiction over the matter while the national union did. P was found guilty by the national union and fined $100. P then filed an action under 29 U.S.C. ¤411 (a)(2) in that the union violated his free speech. P propounded interrogatories and asks for specific statements allegedly made by P for which he was tried by the union and to state which provisions of the union constitution P violated by the statements and also why they violated the constitutional provisions. This was a motion to determine if D should be compelled to answer.
