Facts

Peterson (P) while a guest at the Palm Springs Marquis Hotel alleged that she slipped and fell in a bathtub while taking a shower thus sustaining serious head injuries. P alleged that the tub was extremely slick and had no safety measures. The trial court ruled that Becker would not apply to this case. P then filed a petition for a writ of mandate challenging the trial court's ruling. The court of appeals denied the writ. It was sent to the California Supreme Court and they sent it back to the court of appeals which then directed that the writ should issue applying Becker to hotel proprietors. Ds then petitioned for review.
