Pettit (P) purchased a motorcycle from Liston (D). P was a minor. P paid $125 down and was to pay $25 per month. P used the motorcycle for a month and then returned it, damaged, and demanded his money back. D refused to refund the money and P sued. The action was dismissed by the court and P appealed.
